Diarkis Inc. (the “Company” or “we”) hereby sets forth the following privacy policy (“Privacy Policy”) regarding the personal information and any other such information we handle when we conduct our business activities.  This Privacy Policy shall be governed by and construed in accordance with the laws of Japan, and the controlling language of this Privacy Policy shall be Japanese.

Compliance with laws and regulations

The Company and its officers and employees will comply with the following personal information protection polices when conducting our work.

1. Compliance with rules and regulations regarding personal information

When handling personal information, we will comply with all laws and regulations, guidelines prescribed by the governments, and any other such standards relating to the handling of personal information.

2. Handling of personal information

In collecting personal information we will use lawful and fair means and specify to the extent possible the purpose of its use.  We will only use personal information within the scope necessary to achieve its specified purpose of use.

3. Appropriate management of personal information

We will take organizational, individual, physical, and technological safety measures regarding personal information, and we will endeavor to prevent and rectify any unauthorized access, divulgence, or loss or damage caused in relation to the personal information.

4. Inquiries or complaints concerning personal information

We will faithfully respond to any inquiries or complaints regarding our handling of personal information.  For details, please see the “Inquires” section below.

Scope

This Privacy Policy applies to the services and other such business activities of the Company.  In cases where the handling of customer information is prescribed under a separate privacy policy for a separate service or an individual terms of use or the like (“Individual Terms”), these Individual Terms will also apply to the services and other such business activities of the Company.  In cases where there is a discrepancy between the provisions of this Privacy Policy and the provisions of the Individual Terms, the Individual Terms will prevail.

Please note that the scope of this Privacy Policy does not extend to the collection of customer information by other operators, etc. such as those linked to by URLs.

Information to be acquired and its purpose of use

The Company will acquire and use the following information in the course of providing our services and performing other such business activities.

1. Information we acquire through providing the “Diarkis” engine (the “Service”) on our website, including:

(1) the name, company name, affiliation, address, phone number, and email address of a customer, information used to validate the account of a customer, and any other such information a customer registers on the Service or that we acquire through the Service, as well as information we have acquired through promotional events, inquiries, and the like; and

(2) cookies, IP addresses, terminal information, browser information, browser language settings, location information, and any other such information relating to the transmission logs of a customer.

The information listed above is used for the following purposes:

(1) to provide the Service and supply other information to customers

(2) to conduct identity confirmation, user validation, and the registration of user settings in the Service;

(3) for support for repairs, etc. of malfunctions in the Service;

(4) to prevent unauthorized use of the Service;

(5) to ensure that the Service can be used without interruption;

(6) to prepare statistical data regarding the use of the Service;

(7) to conduct surveys regarding the Service as it is currently being provided and regarding future offerings of the Service which are under consideration;

(8) to respond to customer inquiries;

(9) to transmit and display advertisements and to measure their effectiveness;

(10) to announce information, etc. regarding the Service or advertising information, etc. of a third-party advertiser;

(11) to conduct and provide new business plan proposals regarding the Service going forward;

(12) to select winners for promotional campaigns, etc. and send prizes and goods;

(13) to conduct identity verification at the time when an inquiry is received, etc.;

(14) to process invoices at the time of product purchase or use of a paid service, etc.;

(15) to transmit information regarding the Service; and

(16) to make any other important notifications or other necessary communications regarding the Service.

2. Information from individuals who apply for the employment screening process of the Company:

(1) information acquired at the time a candidate applies for employment at the Company, such as resumes, professional CVs, and the like.

The information listed above is used for the following purposes:

(1) to provide information regarding hiring at the Company;

(2) to contact and notify applicants of the decision regarding their pass or failure of the employment screening; and

(3) for inner-company HR personnel management purposes after hiring a candidate.

3. Information provided for the purpose of conducting transactions:

(1) information acquired when conducting a transaction with the Company, such as names, affiliations, company names and the like.

The information listed above is used for the following purposes:

(1) for communications necessary for business, the execution of agreements, and business discussions; and

(2) to manage transaction information.

Provision of information

The Company shall not provide personal information to third parties except in the following cases:

(1) if the individual has given prior consent;

(2) if pursuant to laws and regulations;

(3) if a customer is in breach of the Terms of Use of the Service and the Company has sufficient and adequate grounds to determine that is has no choice but to disclose the personal information for the purpose of protecting our rights, property, and services, etc.;

(4) if it is necessary for the purpose of protecting the life, person, or property of an individual and it is difficult to obtain the consent of the owner of the personal information;

(5) if it is especially necessary for the purpose of improving public health or preserving the sound development of minors and it is difficult to obtain the consent of the owner of the personal information;

(6) if the Company is required to cooperate with a national government organ or local government entity, or a person engaged thereby, in the performance of administrative processes prescribed by law, and obtaining the consent of the owner of the personal information is likely to hinder the performance of such administrative processes; and

(7) in cases where personal information is provided following the succession of a business due to a merger, company split, transfer of business, or any other such grounds.

Entrustment of information

The Company may entrust all or part of the personal information obtained from customers to a service provider within the scope necessary to achieve its purpose of use.  In such cases, we will conduct a sufficient assessment of the appropriateness of such person or company as a service provider, and in an agreement with such service provider we will prescribe the matters relating to confidentiality, etc. and develop a system in which information is appropriately managed.

Joint use of information

In cases where it is necessary to conduct business jointly with a business partner when providing the Service, there are times when personal information of customers may be jointly used by that business partner.  In such cases, we will jointly use the personal information after announcing to customers the purpose of use of the information, the name of the business partner, the types of information to be jointly used, and the name of the person responsible for the management of the personal data.

Rights of the customer

A customer wishing to receive disclosure from the Company of personal information that is unable to be confirmed on the website of the Service may make a request for disclosure in accordance with the procedures prescribed separately by the Company, expect in the following cases:

(1) in cases where such disclosure would likely be detrimental to the life, person, property, or any other such right of the customer or a third party;

(2) in cases where such disclosure is likely to substantially compromise the appropriate implementation of business of the Company;

(3) in cases where such disclosure would violate laws and regulations; or

(4) in cases where the Company is unable to verify that the disclosure request was made by the customer to whom the personal information pertains.

In cases where the customer determines that there is a factual error in the content of the personal information the Company possesses regarding the customer, the customer may request the revision, addition, deletion, or suspension of use of the personal information by the Company by following the procedures prescribed separately by the Company.  In such cases, the Company will conduct an investigation without delay and within the scope necessary to achieve the purposes of use, and if as a result of that investigation it is determined that the Company bears a duty under laws and regulations, the Company will make such revision, addition, or deletion, or suspend its use of, the personal information.

Please note that there are cases in which a disclosure fee will apply in accordance with the procedures prescribed separately by the Company in cases where a customer makes a request for the disclosure of personal information that the customer is unable to confirm on the website of the Service.  While the provision of personal information from the customer to the Company is voluntary, there are cases in which the customer may not be able to use a part of the Service if the necessary information is not provided by the customer.

Revisions to this Privacy Policy

The Company may revise this Privacy Policy as necessary.  However, if the revision of this Privacy Policy would by laws and regulations require the consent of the customer, the revised Privacy Policy will only apply to customers who have given their consent to the revisions by the method prescribed by the Company.  In cases where the Privacy Policy is revised, we will inform or notify customers of the implementation period and content of the revised Privacy Policy by indicating such information on our website or by other methods that are easy for customers to access.
